ME AND MY WIFE ARE CURRENTLY IN A DIVORCE WE WERE TO MEET WITH ALL PARTIES WITH HER ATTORNEY. JUST TO FIND OUT SHE CHANGE ATTORNEY THE DAY BEFORE THE MEETING. WE DON'T HAVE ANY ASSET ALL WE HAVE IS DEBT. WE HAVE A HOUSE THAT IN MY NAME AN I AM WORKING WITH THE BANK TO TRY AND SAVE THE HOUSE. FOR THE LAST NINE MONTHS SHE WAS NOT HELPING PAY ANY BILLS.SHE IS COLLECTING UNEMPLOYMENT AND SHE FEEL THAT THE COURT WILL NOT MAKE HER MOVE BECAUSE SHE HAVE KIDS I ALSO HAVE THREE KIDS LIVING IN THE HOUSE WE HAVE ONE CHILD TOGETHER. I AM TIRED AND DON'T KNOW WHAT TO DO BECAUSE THE ARE RUNNING UP ALL THE UTILITIES BILLS. NOT KEEP THE HOUSE CLEAN IT NOT A GOOD ENVIROMENT TO BE IN I JUST WANT TO KNOW IF I HAVE ANY LEGAL RIGHT TO HAVE HER EVICTED BECAUSE SHE IS NOT HELPING PAY ANY BILLS.

ME AN MY WIFE ARE IN A DIVORCE THE MORTAGE FOR THE HOUSE IS IN MY NAME I AM CURRENTLY IN A FOREBEARANCE PLAN WITH THE BANK. THE BANK IS HELPING ME TO TRY AN SAVE THE HOUSE. THERE IS NO VALUE IN THE HOUSE SO IT'S POINTLESS TO SELL AT A LOST I WANT TO KEEP THE HOUSE BECAUSE IT IN MY NAME ONLY AND IF IT'S GOES INTO FORECLOSER I WILL BE THE ONLY LOOSER I HAVE THREE KIDS THAT LIVE IN THE HOUSE AND SHE HAVE FOUR KIDS WE HAVE ONE CHILD TOGETHER. AND SHE IS COLLECTING UNEMPLOYMENT SHE IS NOT PAYING ANY BILLS. I AM STRUGGLING TO PAY THE BILLS AND TAKE CARE OFF MY KIDS. WHILE SHE JUST SPEND HER MONEY, CAN I HAVE HER EVICTED WHILE WE ARE IN THE PROCEE OFF A DIVORCE

My husband and I were visiting fl. and he left me here!

He is filing a chapter 7. I have Multiple Sclerosis, and

all I have is our house, which he is including in the 7.

What do I do???????????????????

I am the mortgage holder, he is on title, I don't work and haven't

for quite some years..

situation...divorce will be final on 8/2/608. i received foreclosure notice last Thursday. my soon to be x wanted and was granted the home, she hasn't made a payment since april even tough i was ordered to pay her $1000 a month to "assist" her in maintaining her lifestyle.

what are my options....i do not want to keep the house, but dont want to lose 200k that i will have in the bank after 8/26/08

please help.

Thanks for the link, Kimberly. I read it -- helpful, but unfortunately I can't blame him for identity theft. Here I've been so proud of myself for keeping my credit good through the last several years since my divorce, due to fairly frugal living and careful bill paying -- only to have this situation screw it up. Ugh.

If your can't afford to make the mortgage payments, and there's no equity in the house, you would probably better off filing for chapter 7 and have all your debts discharged. This is not legal advise only the opinion of someone who's been there, done that.

I learned the hard way that you need to get a copy of your credit report and immediately cancel all jointly held credit cards.

I am now being held responsible for $12K my ex charged on a card I didn't know we stil had.
