When we entered into a prenup, we did not consider the repercussions of standard legal language of each retaining our own "personal property." When my spouse unexpectedly died a few years after marriage, it became extremely painful to experience stepchildren requesting all my spouse's personal property. The property does not have a monetary value; it has sentimental meaning and it was very difficult to part with before I was ready to. When entering into a prenup before marriage, you do not think about ramifications of death. Beware.

The best bet is to just not get married in the first place. As a man, you have to realize that the courts are all stacked against you.... 2/3 divorces are initiated by women, and you can bet that she will take most of the money you earned during the marriage, in addition to being a wage-slave for the rest of your life with alimony and child support.

Just say no. Even if you have kids.. Child support is pretty rough, but at least you can keep your house and not get stuck with additional alimony payments and the money you earned when you were with the mother.

Amen to the comment previous. Makes it sound like divorce is in the cards when you must have a prenup to begin with. We need another article on how to better prepare for marriage which would lead to less divorces.

Gaaahhh! As someone who used to do estate planning, this is one of my biggest pet peeves: presenting prenups as if the only thing they address is what happens if you divorce. Not true! They also address issues such as inheritance rights if the marriage doesn't end in divorce, which can be especially important in second marriage situations where one or both spouses may have children whose rights they want to protect. Articles such as this which perpetuate the "getting a prenup means you think you'll divorce" idea make it that much more unlikely that committed couples who really need one in case they *don't* divorce will actually get one.
