This post is the most accurate answer you will get without more details. The only way this can actually be used against you in court is if there is a line on the write up that states "I agree with this Employee Warning Statement" or something to that nature saying that you agree to what is said above. In that case, I would not sign it if you do not agree. However, remember that Employment at Will can be terminated at any time, for any reason, with or with out notice; not signing that paper could be just the strike that sends you home!

I signed my write up after i was told i was terminated and stated that the allegations against me were false and unjustified, and signed it to aknowledge that i received the form, On trying to receive unemployement, after a few weeks, i was contacted by the Texas Department of Unemployement, the lady said , " that because i signed the form, i could not receive unemplyoment benefits, because i signed it addmitting just cause for being terminated. Whats up with that? FYI in previous write ups, which have been very few, i have never signed one, now i no why, for so many reasons.I suggest, dont sign it, with your name, but only with your rebuttle, again, not your signature, that belongs to you in so many civil rights....

I was pretty ill a couple of days ago and ended up sleeping two hours longer than I should have. I was supposed to be at work at 9am, but I over slept till 11am. I went straight to the phone and noticed I had a text message from my department head asking if I was coming into work. I text him back telling him I needed to call out, I wasn't up to par and could tell I wouldn't have performed at work well if at all if I went in. He text me back a few minutes later saying,"Its fourth of July weekend, thanks!..." I text him back saying I never complained when I was made to do more work when someone else had called out while he was on vacation. I text him again saying I was sorry and I would come in on my day off to help catch up. He text once more asking who it was that called out, which was irrelevant to me and I told him I don't need to name off. He never told me if he wanted me to come in on my day off so I went up to work anyway, and he asked what I was doing there. I told him I was working and he said I don't need to be there. I asked him, you want me to go home and he continued saying yes and that he didn't need me that day, he needed me the day I called out. I go home for the day and return the next only to be written up by the store director for "not reporting to work and my disregard for my department head". I wasn't trying to justify my actions by telling my store director how other co-workers, that are closer friends to the department head, call out to my department head through a text just about every time they call out. If they do actually call, not text, its because the department head isn't at work to receive the message and compensate for the short handedness. I know what I did was not right, but If I hadn't had received the text message I would have called the department head directly. I really don't know what to do but the most I seek is to have the written warning taken off of my work record.

My husband worked a full shift as an ast. mgr @ a movie theater, at the end of the night, he did his normal paperwork, sent out reports, did all deposits and counted the safe. All was fine. He was off the following day but gets a call from his boss between 8:30 and 9:00pm saying that the safe was $100.00 short and she didn't have a chance to count it until that time. A few days pass, as he was working and completing his paperwork, he came accross a write up that his boss prepared for him about the missing money. He sent her boss in Corporate an email to move him to another position while he looked into this situation. He also indicated what transpired and questioned the write up. This took place over a month ago, no response from corporate and even worse...now he went from working 35 to 40 hours a week to 6 to 12 hours a week. He is in the process of looking for another job & filing unemployment. Isn't there something he can do?
