ok i am to return to work in two day's yeah a lil late right ... but i was planning on goin back but my boyfriends job is now going to 3 cruise witch mean he will be working 1st 2nd and 3rd shift i work 12hr nights and we would not have anyone who would watch our son what should i do

But what happens if the person above her boss decides not to continue her health insurance coverage while she is on leave. And can the company legally terminate her employment the day before she goes on maternity leave, and would that impact her short-term disability pay? I'm in a very similar situation at the moment and these are my concerns about being up front with my boss. I think he would be understanding, but I'm not sure HIS boss would, and ultimately he calls all the shots.

It says in SOME circumstances...not all, that the employer can recover payments to health insurance on behalf of employee...

Maintenance of Health Benefits

A covered employer is required to maintain group health insurance coverage, including family coverage, for an employee on FMLA leave on the same terms as if the employee continued to work.

Where appropriate, arrangements will need to be made for employees taking unpaid FMLA leave to pay their share of health insurance premiums. For example, if the group health plan involves co-payments by the employer and the employee, an employee on unpaid FMLA leave must make arrangements to pay his or her normal portion of the insurance premiums to maintain insurance coverage, as must the employer. Such payments may be made under any arrangement voluntarily agreed to by the employer and employee.

An employer's obligation to maintain health benefits under FMLA stops if and when an employee informs the employer of an intent not to return to work at the end of the leave period, or if the employee fails to return to work when the FMLA leave entitlement is exhausted. The employer's obligation also stops if the employee's premium payment is more than 30 days late and the employer has given the employee written notice at least 15 days in advance advising that coverage will cease if payment is not received.

Keep in mind the Family Medical Leave Act, does allow an employer to collect for their share of health benefit premiums paid on an employee's behalf if the do not return to work after exhaustion of FMLA leave, unless there are cicumstanced beyond the employee's control (continued illness, etc.).

well i would like to conbritue on this topic,i had my baby last year dk ec and i,m suspose to return back to my job on the 5 of july and i found out that i,m pergnant again and i love my job and my manager wants me to come back to work and i love going backk and i the only promblem i ave is that i don,t know if they will accept me back and i don,t know who long i will able to work and get another maternity leave

Absolutely...I also advise women not to be so certain about their future carer plans until after they've given birth. I've seen so many women change their minds during their maternity leave.
