If the complaint is much more serious, and nothing has been done after you have spoken to a superior, it is time you wrote a memo to your personnel file regarding the matter and move on.

I'm going through this right now. I feel like I was hired to break the law, unknowingly. Unfortunately, I'm a freshly minted MBA grad and the laws of business are fresh in mind. It has been a struggle with HR but they have my back and apparently are doing their best to create a file to proper terminate my superior - and supposedly he's been on the chopping block for a while but they wanted hard core evidence to prevent a lawsuite but I hate being in the middle. They even had to pull out the whistle blower law and tell him I was protected by that - after he threatened to fire me for going over his head. (He didn't seem to care about the embezzlement or federal money fraud.) It is an awful situation but I just know on the other end, I am going to be okay. Just not fun being in the middle of it right now.

One thing I would add is, with the possible exception of the illegal/harassment situations, you ALWAYS should talk to your own boss directly about the situation, before you go on to talk to your boss' boss.

Excellent advice as always AAM.

A couple of thoughts - if it's a harrassment (or bullying) situation, the employee should go to their HR rep straight away. HR is trained to advise and document these types of situations. It is critical the details be documented asap in case there are future legal proceedings

If it's something illegal, many companies have a confidential phone line where employees can report this type of issue. Check your company's Code of Ethics policy for the info. Or again, talk to HR since they can help with next steps.

I have found there are people in a company who are excellent at solving interpersonal issues (it's not always HR or management, could be some guy/woman in Accounting!) so employees can speak to someone like that for advice. Go for coffee, and get their perspective on the situation.

I would caution people against talking about the situation with a variety of other employees because word gets around and could be very damaging to your reputation and create a lot of unnecessary fuss.
